Terms of Use

These Terms of Use ("Terms") govern your use of Moto-Tracks, a motorcycle navigation and route-planning service ("the Service"), available as a website and as a mobile app. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

The Service is not directed to children under 13, and you may not use it if you are under 13. You are responsible for keeping your account credentials secure and for all activity under your account.

Your content

The Service lets you create content — including routes (names, descriptions, waypoints), ride records, and your display name. You keep ownership of your content. When you mark a route as public, you grant Moto-Tracks a non-exclusive licence to display it to other riders (alongside your display name) within the Service, until you make it private again or delete it. You are responsible for the content you post and confirm you have the right to post it.

Acceptable use — zero tolerance for objectionable content

There is zero tolerance for objectionable content and abusive behaviour. You must not post, share, or transmit content that:

• is offensive, abusive, harassing, threatening, hateful, or discriminatory;
• is sexually explicit, obscene, or otherwise inappropriate;
• is unlawful, defamatory, or infringes anyone's rights;
• is spam, a scam, or deliberately misleading; or
• impersonates another person or misrepresents your identity.

You must not harass, abuse, or harm other riders, or attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.

Reporting, moderation, and blocking

You can report any public route you find objectionable from within the app and on the web. We review reports and remove violating content, typically within 24 hours. A route that is reported by multiple riders is hidden automatically pending review. Content reported as objectionable will be ejected and the responsible user may be removed.

You can also block another rider, which immediately hides their public content from you. Blocks are managed in Settings and can be reversed at any time.

Enforcement and termination

We may remove content and suspend or terminate accounts that violate these Terms, with or without notice. You can delete your own account at any time (Settings → Account → Delete account, or the web sidebar).

Navigation & safety disclaimer

Routing, navigation, speed-limit, and traffic information are provided "as is" and may be inaccurate or incomplete. You are responsible for riding safely, obeying all traffic laws and speed limits, and using your own judgement. Do not interact with the app while riding in a way that distracts you from the road.

Subscriptions and paid features

Some features may in future be offered as paid plans. If you purchase a subscription or paid feature, the price, billing period, and renewal terms will be shown to you before purchase. Purchases made through the Apple App Store or Google Play are processed and governed by the applicable store's terms, including their billing, auto-renewal, and refund policies. Unless required by law, fees are non-refundable.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Moto-Tracks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service, including any reliance on routing or navigation data. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence.

Governing law

These Terms are governed by the laws of the United Kingdom, and the courts of the United Kingdom have jurisdiction over any dispute — except that, if you are a consumer, you may also bring proceedings in your country of residence where local law gives you that right.

Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.
